What are the penalties for DUI?

It varies as to the severity of the DUI and whether there are prior convictions or injuries involved.  Penalties include jail, fines, alcohol education classes, ignition interlock devices and probation.

How do you avoid having your license suspended?

You must file an appeal with the DMV within 10 days after the arrest.  You will receive a DMV hearing at which you must prevail. At the hearing your attorney will raise defenses to show that the stop or arrest was illegal or that the alcohol screening was improperly done.

What can you do if your license is suspended for DUI?

You can request through the DMV a restricted license to allow you drive to and from work or school.

What is the Field Sobriety Test?

This is a collection of tests which a police officer may conduct at the arrest site to determine whether to arrest you for DUI.  They are mostly physical agility exercises such as standing on one leg or walking on a line.  If you fail to do the tests properly, the officer will submit this as evidence of DUI.  The most dangerous test is the Preliminary Alcohol Screening test which is a breathalyzer test taken in the field.  If it shows that you are over .08 BAC, it is strong evidence against you in court.

I refused to take the breath test? How can I save my license?

You need to appeal for a DMV hearing within 10 days of the arrest.  Your attorney may defend you on grounds that the stop was illegal, you were not advised of the consequences of refusing to take the test or that the police officer was too quick to accept your refusal and did not persist in the request.
